Abstract As the end of the Middle Ages was drawing to a close, the water resource lay at the centre of intense disputes among the possessors of feudal territories and between these and populations claiming a legitimate and customary use of it. These disputes led to a mutual sharing of information between the parties involved and exchange of skills and technical knowledge that crossed the boundaries of political districts. These actions focused mainly on economic exploitation and military defence, but also on protecting the health of inhabitants. Feudal families were at the centre of control activity. A prime example of this is Roffredo III Gaetani (c. 1270–c. 1335). In his precarious position as a lord hated by the Colonna family and other potentates in Campagna, he attempted to safeguard his ‘state’ with agreements, truces and concessions. On the strength of the position he had gained in the affairs of the Kingdom of Sicily, he succeeded in the years following 1319 in restoring the fortress of Fondi and imposing a seigniorial action based on ‘useful dominion’, which in itself encompasses the concepts of uti­frui and fruit, as in yield. With regard to the history of law and mindset of the time, the ability of Roffredo III to intervene in his dominion, planning its organisation for economic exploitation and military defence, appears to be significant and worthy of further investigation.
